Terms of service
These terms are between you (the business using Loudmill) and Aarya Technologies Ltd (“we”), a company registered in England and Wales, number 08845253, registered office Arena Business Centres, 100 Berkshire Place, Winnersh, Wokingham RG41 5RD. Loudmill is our product. Questions: hello@loudmill.com.
Loudmill is for businesses, not for personal use. When you create a business in Loudmill you accept these terms, and the data processing agreement that is part of them, for your business, and confirm you’re allowed to. We record which version was accepted, when, and by whom.
What Loudmill does
Loudmill drafts social posts, emails and replies for your business with the help of AI, shows them to you, and publishes the ones you approve to the accounts you connect (for example your newsletter, Bluesky or Mastodon today, and Facebook, Instagram, LinkedIn or your Google Business Profile as each platform approves Loudmill). Nothing is published without a person in your business approving it. A follow-up email you switch on goes to each customer who qualifies once you’ve approved its wording; if the wording changes, it waits for approval again.
Loudmill is in early access. Features change as we improve it, and we’ll tell you before removing anything you rely on.
What you’re responsible for
- What you approve. AI can get things wrong. Read each draft before approving it: once approved, it is your post, published in your name. Loudmill flags claims, figures and offers it can’t match to your business details, but it can’t know everything about your business.
- Your contacts. Only add people you’re allowed to email under UK law (PECR and UK GDPR). Loudmill asks which of these applies to each contact:
- They agreed to hear from you by email (consent).
- They’re your customer (“soft opt-in”): you got their address when they bought, or asked about buying, something from you; you only email them about your own similar products or services; you gave them a simple way to say no when you collected the address; and they haven’t said no since.
- They’re a business contact at a company, LLP or public body (not a sole trader or an ordinary partnership, which count as individuals): you may email them if it’s relevant to their job, but UK GDPR still applies, so tell them who you are and stop if they ask.
- Your photos and words. Only upload photos and text you have the right to use, and only share a customer’s photo or review when they’re happy for you to.
- The platforms’ own rules. Facebook, Instagram, LinkedIn, Google and the others have their own terms. Posts made through Loudmill must follow them too.
- Your account. Keep your sign-in safe, give team members only the role they need, and tell us at once if you think someone has got in.
What you mustn’t do
Don’t use Loudmill to publish anything unlawful, misleading, hateful or infringing; to send spam; to pretend to be someone else; or to try to break, overload or get round the protections of Loudmill or the platforms it connects to. We can pause or close an account that does.
Your content
Your business details, photos, contacts and posts stay yours. You let us use them only to run Loudmill for you: to draft, show, store and publish them, and to send them to the services that do that work (our subprocessors). Personal data about your customers is handled under our data processing agreement, and everything else as in our privacy notice. We don’t sell your data or use it to advertise to anyone.
You may use the text and pictures Loudmill makes for you in your business. We don’t claim any rights in them, but AI can produce similar results for others, so we can’t promise they’re unique or that anyone owns copyright in them. AI pictures are labelled as AI-made.
The Loudmill software, name and design are ours.
Price and paying
During early access, the price (if any) is the one we agreed with you in writing. Before we start charging you, we’ll tell you at least 30 days ahead, and you can stop before it applies.
When paid plans start:
- Plans are monthly, paid by card in advance through our payment provider (Stripe). Prices are shown in pounds, and whether VAT is added is stated next to each price.
- A plan renews every month until you cancel. You can cancel any time in Loudmill’s settings, or by emailing us; it ends at the end of the month you’ve paid for, and you keep using Loudmill until then.
- We don’t refund part months, except where the law requires it, or where we end the service early (then we refund the unused part).
- If a payment fails, we email you and try again. If it still hasn’t been paid after 14 days, we can stop drafting and posting until it’s paid; you can still sign in, see and download everything, and nothing is deleted.
- A free trial, if we offer one, never turns into a paid plan unless you choose one.
- We give at least 30 days’ notice of a price change, and you can cancel before it applies.
- You can add extra AI pictures or short AI clips at any time. What you add never runs out while your account is open. If you haven’t used them, you can get a refund for the unused part within 30 days in Loudmill’s settings, or ask us after that. They end if the business is closed.
Fair use
Your plan covers everything you need for your weekly marketing. Your weekly drafts, your own words and edits, your own photos, text cards, Make it move and every size are included without limits.
AI creations each come with a generous monthly amount:
- 1,000 AI rewrites, ideas and reply drafts: far more than a busy business normally uses;
- 40 AI pictures;
- 8 short AI clips.
You can always see what you’ve used in Settings → Plan and usage, and we’ll let you know when you’re getting close.
If you reach an amount, that feature pauses until the 1st of the month, and everything else carries on as normal. You can add more AI pictures and clips at any time. For more AI writing, email hello@loudmill.com and we’ll help.
Fair use keeps Loudmill fast and reliable for everyone. If an account shows far more activity than a business would normally create, we may pause AI features while we look into it, and we’ll get in touch.
Stopping
You can stop at any time: Settings → Download all your data first if you want a copy, then Delete this business. What’s deleted, and when, is in our privacy notice. We can end the service with 30 days’ notice, or at once if an account breaks these terms or the law. Either way you can have a copy of your data first: see section 8 of the data processing agreement.
If something goes wrong
We work hard to keep Loudmill running and your data safe, but we can’t promise it will never be unavailable or never make a mistake, and the platforms it posts to can change or stop their services. If a post doesn’t go out, Loudmill tells you, and keeps it for you to post yourself.
We’re not liable for: loss of profit, revenue, business, goodwill or anticipated savings, whether direct or indirect; any indirect or consequential loss; or what a platform or other service does. Otherwise our total liability in any 12 months is limited to what you paid us in those 12 months, or £100 if you paid nothing. Nothing in these terms limits liability that the law doesn’t allow to be limited, such as for fraud, or for death or injury caused by negligence.
Changes to these terms
We’ll tell you by email at least 30 days before a change that matters to you takes effect. If you don’t agree, you can stop using Loudmill before then.
The law
These terms are governed by the law of England and Wales, and its courts deal with any dispute. Please talk to us first at hello@loudmill.com: most things can be sorted out quickly.
